GENERAL CONDITIONS

  1. By filling in the online “Form to attend Inspiration“ the Customer implicitly declare that he has read and accepted the General Conditions and Regulations given below.

  2. By subscribing Inspiration, the operator enters the MICE in Med hub digital platform which projects him into a market made up of over 30,000 buyers all over the world. A dimension that frees from space-time constraints develops its potential based on the new trends and needs of international  markets by proposing the high end offer of the Mediterranean destinations.

  3. All the activities  running on Inspiration in the  MICE in Med Hub platform are supplied by EMI - Eureka MICE International Ltd, a limited company subject to the laws of the Republic of Malta and with official headquarters at 5 Majestic Court - Mary's Street Mellieha MH1337 Malta. Company Registration Number: C-54378 – VAT registration number MT-2058613

  4. Eureka MICE carries out a continuous promotion activity towards 30,000 MICE & Luxury buyers all over the world aimed at stimulating their access to the platform.

  5. Buyers 'access to the stands is governed by structured research systems for the areas that are the basis of customers' travel choices.

  6. One of the main values of Inspiration is to be free from space-time constraints. In fact, buyers can access it at any time, when is more convenient for them. For this reason, the measurement of attendance and audience ratings of the individual initiatives must be carried out over an overall and non-contingent time frame.

  7. To safeguard the interests of all exhibitors present on the platform, Eureka MICE does not interfere with the orientations of buyers who will visit the stands in total autonomy using the selective query systems provided by the platform.

  8. For these reasons Eureka MICE International  is not responsible for the feedback obtained by the suppliers

  9. EMI - Eureka MICE International guarantees the carries out a continuous promotion activity towards 30,000 MICE & Luxury buyers all over the world aimed at stimulating their access to the platform. It is not, however, responsible for the outcome of the contacts and of any transaction, inasmuch as subject to circumstances completely beyond its control. 

  10. The efficiency of the Inspiration platform services depends above all on Suppliers punctually observing the deadlines. To help us provide these services at the best level it is vitally important for Suppliers to cooperate in this sense. Failure to do so risks to jeopardize the success and also the outcomes of the promotion activities and in this case, the Organization cannot guarantee the perfect supply of services. 

  11. EMI Eureka MICE International is not responsible for any loss or damage, cost, expense, loss of profit, punitive damage, damage to public image and any further damage by the Supplier suffered as a result of a substitution, alteration or cancellation/postponement of an event or service. EMI Eureka MICE International shall assume no liability whatsoever in the event the service  is cancelled, rescheduled, postponed or shortening due to a fortuitous event, Act of God, unforeseen occurrence or any other event that renders performance of the event impracticable, illegal or impossible. For purposes of this clause, a fortuitous event shall include, but not be limited to: wars, fire, revolts, riots, strikes, health emergencies or other emergency, inevitable technical problems, terrorist acts, natural or nuclear disasters, fires or adverse weather conditions, unforeseeable events.

  12. In case of insufficient number of subscriptions to a planned  event, the Organization reserves the right to postpone anticipate or cancel it up to 7 days prior to the event. In case of postponement, the organization will inform the Supplier about the new date scheduled. If the new scheduled date is not workable for the Supplier, he will receive a credit for 100% of the contract fee paid. He may use this credit for another EMI Eureka MICE International event to be mutually agreed with EMI Eureka MICE International, which must occur within two years from the date of postponement.

  13. Suppliers give EMI Eureka MICE International the consent for publishing photos/videos of themselves (including photos/videos of any companion) taken during the event both in the event website and in the event directory.

  14. Unforeseeable events: EMI Eureka MICE International Ltd and its consultants/partners are not responsible for any damage due to cancellation, postponement or shortening, totally or in part, of an event owing to reasons not dependent on their control. At the same time EMI Eureka MICE International Ltd and its consultants/partners are not responsible for the loss, damage or delay due to acts of war, thefts, plundering, acts of terrorism, civil disorders, strikes, military activities or other circumstances in which it should be impossible to EMI Eureka MICE International Ltd to guarantee the performance of the event in the scheduled period. 

  15. EMI Eureka MICE International Ltd reserves the right to change the scheduling of the event. 

  16. In relation to technical, logistic and organizational needs of the event and in order to guarantee to participant Suppliers the most convenient and incisive trading between Demand and Supplier, EMI Eureka MICE International Ltd reserves the right to modify the programme. 

  17. The System

  18. Inspiration is a promotional digital system specifically designed and devoted to the MICE and Luxury international markets. 

  19. Inspiration  works via MICE in MED Hub  the dedicated digital 3D platform.


  20. The system, complete with its applications, is supplied by EMI Eureka MICE International to the Clients on the conditions given below.

  21. The use of the Platform is temporary, limited exclusively to the period signed by the customer.

  22. The participation is directly managed by the client.

  23. Permission to use the platform services  is granted on an exclusively personal and non commercial basis. The user is therefore not allowed to resell, use, copy, insert deep-links, monitor (using, for example, spider, scrape), display, download or reproduce any content or information, software,  products or services available on the system for any type of activity having a commercial or competitive purpose.

  24. The system, the individual applications, the website and the logo are the exclusive property of EMI Eureka MICE International 

  25. In performing the services EMI - Eureka MICE International will disclose, via the system, the data and information that the facility/service provider will have entered directly into the system and for this reason EMI is not responsible for the information displayed, for which the client who entered them are exclusively and directly responsible.

  26. Despite monitoring and controlling the system and the service in general, EMI Eureka MICE International can in no way be held responsible for the information supplied through the system or service providers directly. Likewise, EMI Eureka MICE International cannot be held responsible for any errors (including obvious or typing errors), interruptions to the service (whether due to temporary and/or partial breakdowns), repairs, upgrades or maintenance on the service platform or anything else), for imprecise, misleading or false information or for failure to deliver such information. Each facility/service provider is responsible at all times for the accuracy, completeness and correctness of the  information displayed on Inspiration. 

  27. When the system and the link for access to the service are started up, the Client is also provided with the credentials for accessing the dashboard control panel dedicated to the event. From this panel the Client  can constantly monitor the trends of the visits to the stand checking them in real time.

  28.  EMI - Eureka MICE International is the exclusive owner of Inspiration brand and the platform system MICE in Med Hub and holds all the rights, title deeds and interests related to this system, as well as all the intellectual property rights linked to the graphics and general interface of the system via which the service is made available.

  29. Any use of the logos or of the whole or even just a part of the systems and contents therein represented not expressly authorized in writing is absolutely forbidden.

  30. Any use not compliant with the laws in force constitutes a breach of EMI - Eureka MICE International’s intellectual property rights.

  31. This document and “Regulations”, published on the Website, is an integral part of the Registration Form. The sending of a Registration Form from the part of the Supplier means the total acceptance of all clauses quoted in this document. 

  32. For anything not expressly foreseen by these conditions, please refer to the European and Maltese laws in force.

  33. The place of jurisdiction for any controversy is the Republic of Malta.

  34. The original text of these Service Conditions  is the English text, the only one to have legal value in the event of controversy.

 

 

 

 

 

 

 

REGULATION

  1. Participation in Inspiration is strictly limited to Suppliers able to propose deals in line with the needs and characteristics of the reference markets. Eureka MICE international reserves the right to reconfirm participation after assesment that the stated requirements have been met. 

  2. Registration to services and events organized by EMI Eureka MICE International Ltd. (hereinafter called “the Organization”) may be sent from any hotel, congress centre, hotel chain, convention bureau, promotional consortium, product club and so on (hereinafter called “Suppliers”) through the duly filled in Registration form, and concurrent payment of the downpayment/deposit in it specified. The sending of the Registration form indicates a formal engagement on the part of the Supplier.

  3. Registration to Inspiration  may be sent from any hotel, boutique hotel, historical location, congress centre, hotel chain, convention bureau, promotional consortium, experiential products and services,  product club, DMC, Receptive agency and so on (hereinafter called “Suppliers”), through the duly filled Registration form, and, at the same time, the payment of the participation fee.   Sending the Registration Form without simultaneously paying the amount due does not entitle the Suppliers to formally register for Inspiration.

  4. Sending the Registration form indicates a formal engagement on the part of the Supplier.

  5. Registration fees include all services as indicated in the Registration form. 

  6. Registration forwarding of Form and full payment through:

-  the online portal system 
- wire transfer to EMI Eureka MICE International Ltd (Bank BOV-Bank of Valletta, Republic Street, Valletta, Malta -  IBAN:  MT48VALL22013000000040020496023 SWIFT: VALLMTMT).

7. Terms of payment: Full payment at the moment of the registration.

8. Invoices will be issued by EMI Eureka MICE International Ltd, established in Malta, 5 Majestic Court, St.Mary’s Street MLH1337 Mellieha. If the Customer      is a VAT-registered business (registered in the VIES VAT information exchange system), reverse charge mechanism applies and VAT is not added. If Customer      is not a VAT-registered business or it is a Customer VAT registered in Malta, Maltese VAT is applied.

9. Full payment of the fee is an essential condition for gaining access to the Inspiration services.

10. Suppliers are anyway still required to pay the whole registration fee, even if they have not been able to access to the services due to their failure to pay the        fee in good time.

11. The Suppliers effective registration to Inspiration is finalised once Eureka MICE International send the Supplier a written communication, confirming                participation and services required. 

12. The registration fee includes all services indicated in the registration form. 

13. Once received the confirmation of the registration the Supplier cannot withdraw from the contract. In any case, if the Supplier fails to pay the settlement -        of the services or fails to attend the event, EMI Eureka MICE International Ltd shall have right to withhold any sum already paid by the Supplier.

14. If a Supplier fails to settle their fees within the scheduled deadlines or fails to attend the event, the Organization will have the right to withhold any                   amount  already paid by the Supplier and require the settlement of any outstanding amount.

15. The use of all data (personal data, all buyers company references) and any other information related to buyers received through the System is allowed only         to those Suppliers up to date with payments and registration and are limited to aspects connected with promo-business interactions held during                       Inspiration's period. The Supplier undertakes not to publicize, communicate and spread the reserved information concerning buyers in any way (for                   example, orally and in writing or through the web) to any person or party. The Supplier undertakes to protect the Reserved Information privacy and to use           any appropriate method to assure this kind of protection. For this reason, any different use is rigorously forbidden and shall be prosecute, according to the         international privacy laws. 

16. Failure to comply with this rule, in addition to violating the privacy of the Buyer, causes damage to other Suppliers attending Inspiration  and is                         detrimental   to the image of the Organization which is required to protect the confidentiality and privacy of the Buyers. In case of proven violation of this           rule, the Supplier will lose the right to attend Inspiration while remaining bound to the full payment of the participation fees which will be retained by the         organization in compensation. As far as EMI Eureka MICE International Ltd is concerned, in case of divulgation and/or use of Reserved Information                   concerning Buyers in violation of the previous regulations, the Supplier must pay to the Organization the sum of € 20,000.00 (twenty thousand) as                   penalty, without prejudice to indemnity for any greater injury (that may be) suffered. 

17. According to the privacy law, personal details may be provided only by the Buyer. Under the current privacy regulations it is up to each Seller to obtain              directly from the Buyers of interest the references for any subsequent contact, bearing in mind that is the unquestionable right of the Buyer to decide                whether or not to provide such data to the Supplier.

18. If the Supplier fails to settle the fees within the scheduled deadlines or fails to attend Inspiration, the Organization will have the right to withhold any                amount already paid by the Supplier and require the settlement of any outstanding amount.

19. In the event that EMI Eureka MICE International postpones or suspends the service for any reason and the Supplier is unable or unwilling to attend in on          the rescheduled date, he will receive a credit equal to 100% of the unused portion of the service. He may use this credit for another EMI Eureka MICE              International service or event to be mutually agreed with EMI Eureka MICE International, which must occur within two years from the date of                             postponement.

20. Except as specified above, no credits will be issued for cancellations. There are no refunds given under any circumstances.

21 This document and “General Conditions”, published on the Website, is an integral part of the Registration Form. The sending of a Registration Form from          the part of the Supplier means the total acceptance of all clauses quoted in this document. 

22. APPLICABLE LAW – This document is regulated according to the Maltese law.

23. JURISDICTION - The Court of la Valletta, Malta, shall have exclusive jurisdiction over any disputes between the Organization and the Supplier relating to             the terms and conditions mentioned in this document concerning the subscription and participation in the Events.
